These Terms of Service ("Terms") govern your use of the MarkTheDay mobile application and website operated by ByteImpact Labs LLC ("we," "our," or "us"). By using MarkTheDay, you agree to these Terms.
1. Acceptance of Terms
By downloading, installing, or using MarkTheDay, you agree to be bound by these Terms. If you do not agree, do not use the app or website.
2. Description of Service
MarkTheDay is a countdown timer application for iOS, iPadOS, and watchOS that allows you to:
- Create and manage countdown events with custom colors, emojis, and categories
- View countdowns via home screen widgets, lock screen widgets, and Live Activities
- Sync events across devices using iCloud
- Receive reminders and notifications for upcoming events
- Browse and add public holidays for your country
3. User Accounts & Data
MarkTheDay does not require account creation. Your data is stored locally on your device and optionally synced via your Apple iCloud account. You are responsible for maintaining the security of your device and iCloud account.
4. Acceptable Use
You agree not to:
- Reverse engineer, decompile, or disassemble the application
- Use the app for any unlawful purpose
- Attempt to interfere with the app's infrastructure or other users' experience
- Redistribute or sublicense the application
5. Intellectual Property
MarkTheDay, including its design, code, graphics, and branding, is the intellectual property of ByteImpact Labs LLC. All rights are reserved. Your use of the app does not grant you ownership of any intellectual property.
6. Subscriptions & Purchases
Certain features of MarkTheDay may require a purchase or subscription. All purchases are processed through the Apple App Store and are subject to Apple's Standard EULA. Refunds are handled by Apple in accordance with their refund policies.
7. Availability & Updates
We strive to keep MarkTheDay available and up to date, but we do not guarantee uninterrupted access. We may release updates that change features, fix bugs, or modify the app experience. Continued use after updates constitutes acceptance of any changes.
8. Disclaimer of Warranties
MarkTheDay is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
9. Limitation of Liability
To the maximum extent permitted by law, ByteImpact Labs LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of MarkTheDay, including but not limited to loss of data, missed events, or device issues.
10. Indemnification
You agree to indemnify and hold harmless ByteImpact Labs LLC from any claims, damages, or expenses arising from your violation of these Terms or misuse of the application.
11. Termination
We reserve the right to suspend or terminate access to MarkTheDay at our discretion, without prior notice, for conduct that we believe violates these Terms or is harmful to other users or us.
12. Governing Law
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.
13. Changes to These Terms
We may update these Terms from time to time. Material changes will be communicated through the app or website. Your continued use after changes constitutes acceptance of the updated Terms.
